The Shays Media Fit Check is an independent preliminary assessment intended to help indicate whether ChatGPT Ads may warrant further consideration.

A result:

• is not approval by OpenAI;
• does not guarantee advertiser or campaign acceptance;
• does not guarantee advertising delivery;
• does not guarantee commercial performance;
• does not oblige Shays Media to accept an engagement.

Platform information

ChatGPT Ads and OpenAI requirements can change. Shays Media aims to review material platform information before relying on it for client decisions, but website content may not reflect a change that occurred after its displayed review date.

Where relevant, consult the current official OpenAI documentation before acting on platform-specific information.

Services and contracts

Website descriptions and prices explain Shays Media’s current public service offering but do not themselves create a contract.

Any client engagement is subject to the applicable Shays Media client agreement and agreed scope. If a client agreement conflicts with general website content in relation to an active engagement, the signed/accepted client agreement governs that engagement to the extent permitted by law. These website terms do not replace or override that agreement.

Payment and commencement of services

Where a service requires payment before work begins, Shays Media will not normally start that work until the applicable payment has been received and any information, access or approvals reasonably required to begin have been provided.

For setup services, the setup fee remains refundable until both:

1. Shays Media has been granted the required advertiser-account access; and
2. Shays Media has started client-specific setup work.

Client-specific setup work may include advertiser-account review, offer or landing-page review, customer-intent mapping, context-hint development, campaign setup, tracking review or campaign build.

Once both conditions have occurred, the setup fee is non-refundable, subject to any rights that cannot lawfully be excluded.

Any service-specific payment, cancellation, refund or termination terms agreed with a client are set out in the applicable Client Advertising Services Agreement. Where there is any inconsistency between this website and an agreed client contract, the client contract takes precedence.

Intellectual property

Unless otherwise stated, Shays Media owns or is licensed to use the website’s original text, branding, graphics and other original materials.

You may view and use the website for ordinary personal or internal business reference. You must not reproduce, republish, sell or commercially exploit substantial Shays Media materials without permission, except where the law permits.

Third-party names and marks remain the property of their respective owners.

OpenAI independence

Shays Media is an independent advertising service and is not affiliated with, endorsed by or an official partner of OpenAI.

References to OpenAI, ChatGPT and related services are descriptive and must not be interpreted as indicating sponsorship or endorsement.

The website may link to third-party websites, including official OpenAI resources. Shays Media does not control third-party websites and is not responsible for their availability, content or privacy practices.

Acceptable use

Do not misuse the website by knowingly introducing malicious code, attempting unauthorised access, interfering with security, scraping in a way that materially disrupts the service, or using forms to transmit unlawful or abusive material.

Availability

Shays Media may change, suspend or withdraw website content or functionality. Continuous or error-free availability is not guaranteed.

Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so — for example, liability for death or personal injury caused by negligence, or for fraud.

Subject to that, the website and its general content are provided on an informational basis, and Shays Media is not liable for losses arising from reliance on general website content where individually tailored advice or current platform verification was reasonably required instead.

Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them, including non-contractual disputes, are governed by and construed in accordance with the law of England and Wales.

You irrevocably agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms or your use of this website.

This jurisdiction clause is for the sole benefit of Shays Media. Nothing in it prevents Shays Media from bringing proceedings against you in the courts of your country of domicile, incorporation or principal place of business instead, at Shays Media’s sole discretion.
